General Terms and Conditions 
 
1. When you use a Local Payment Method to make payment, you must authenticate and approve payment directly on your financial institution’s website. Upon logging into your account with the applicable Local Payment Methods, you will see the amount you transacted on our Website and you must confirm and authorize the payment for our services. Upon completing approval, you will either be redirected back to our Website, or you must follow the prompts on your financial institution’s website to return to our Website, in order to successfully complete the payment process. We will promptly generate an electronic mail (“email”) notification to the email address you provided confirming the details of your itinerary. HOTEL ALTERNATE.COM shall not be responsible in any manner whatsoever in the event the email notification fails to be delivered to the email address provided due to any reason which is beyond the control of HOTEL ALTERNATE.COM including without limitation a break down in your internet connection. HOTEL ALTERNATE.COM will be having control/communication, on/with user’s identity through e-mail Id only In case of any wrong e-mail Id or other contact information provided to us, willingly or by mistake, HOTEL ALTERNATE.COM will not be held responsible in that case  
     
2. Price and availability is not guaranteed until the booking is confirmed.  
     
3. XYZ PVT. LTD. has been authorized to process online payment transactions on behalf of HOTEL ALTERNATE.COM The name XYZ will appear as the merchant name associated with your transaction and on the statement provided by your financial institution.   
     
4. Your financial institution may impose an additional fee or other charges to use their payment services (“Payment Servicing Fees”), and you are solely responsible for payment for any and all such Payment Servicing Fees. HOTEL ALTERNATE.COM does not determine or assess such Payment Servicing Fees.  
     
5. Payment Servicing Fees, if any, are not included in the purchase price displayed on your itinerary or the receipts provided by HOTEL ALTERNATE.COM  
     
6. If payment is completed, but the booking is not confirmed by us, your funds will not be sent to HOTEL ALTERNATE.COM Instead, XYZ PVT. LTD. will hold the funds and we will request XYZ PVT. LTD. to return such funds to the originating source.  
     
7. Making a successful payment is not a contract, and HOTEL ALTERNATE.COM makes no guarantee that the travel service or product will continue to be available or be available at the same price in the event a booking is not confirmed.   
     
8. HOTEL ALTERNATE.COM shall have no obligation to replace the unconfirmed booking, accept another booking in lieu of the unconfirmed booking, or to compensate you for such unconfirmed booking. Any subsequent bookings will be treated as a new transaction and will require a new and separate payment. No booking information will be carried over from any previous itinerary. No payment made for a prior unsuccessful booking can be applied towards your new booking.  
     
9. In the event modification of an existing booking for which payment was made results in the need to collect additional funds (for example, a rate increase in a hotel room whether such room was booked alone or in a package), payment for any such additional funds may only be made by (a) a credit card with MasterCard or Visa branding; or (b) by an international debit card, provided your card issuer permits use of a debit card for online or phone transactions. The payment types identified in the preceding sentence must be used to pay any such additional funds, regardless of the original form of payment for such booking.   
     
 
Refunds: 
 
1. Refunded amounts are generally returned within 2 – 5 business days; however, the length of time required for the funds to be credited to your account is determined by your financial institution. Please check with your financial institution on their specific rules regarding returned or refunded transactions. 
   
2. Refunds limited to one per booking. If your travel arrangements are subject to more than one change, it may be necessary to cancel the entire booking; any eligible refunds will be sent to your financial institution to credit your account in accordance with its policies. Rebooking your travel will require a new and separate payment.
   
   
3. HOTEL ALTERNATE.COM has no obligation to issue refunds if:
   
  HOTEL ALTERNATE.COM received payment within ___more days prior to our receipt of the refund request for a booking transaction;  
       
    The purchase requires more than one refund or credit;  
         
    In response to a disputed booking appearing on your statement from your financial institution, your financial institution issues you a refund for the disputed booking transaction and sends HOTEL ALTERNATE.COM a charge back on the transaction (a charge back reverses the payment you made to HOTEL ALTERNATE.COM for the refunded transaction);  
         
    You cannot provide us with full and accurate information required to complete the refund or credit;  
         
    The refund request has already processed through XYZ but has not yet applied to the originating source of the payment;  
         
    The refund request directs HOTEL ALTERNATE.COM to issue the refund to a different financial institution than the source where the original payment was received; or  
         
    HOTEL ALTERNATE.COM did not received the payment for which the refund request is made due to force majeure or other causes beyond our direct control.  
         
4. Refunds requiring special handling may result in a delayed return of the funds:

In the event a refund cannot be handled within standard refund protocols or to process a refund after ___ days, you may be asked to supply additional information and to provide documentation of the original charge. Information disclosed to HOTEL ALTERNATE.COM for the purposes of processing a customer refund will be protected in accordance with our current Privacy Policy.
   
 
TRAVEL DESTINATIONS 
 

Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. HOTEL ALTERNATE.COM urges passengers to review travel prohibitions, warnings, announcements and advisories issued by the national foreign office of your country.

By offering for sale travel to particular international destinations,HOTEL ALTERNATE.COM does not represent or warrant that travel to such points is advisable or without risk, and is not liable for damages or losses that may result from travel to such destinations.

 
DISCLAIMER
 

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the accommodation as made available on our website, (iii) the services rendered or the products offered by the accommodation provider, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the accommodation (its employees, directors, officers, agents, representatives or affiliated companies), including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

Unless stated otherwise, the software required for our services or available on or used by our website and the intellectual property rights (including the copyrights) of the contents and information of and material on our website are owned by HOTEL ALTERNATE.COM, its suppliers or providers.

HOTEL ALTERNATE.COM exclusively retains ownership of all rights, title and interest in and to (all intellectual property rights of) (the look and feel (including infrastructure) of) the website on which the service is made available (including the guest reviews and translated content) and you are not entitled to copy, scrape, (hyper-/deep)link to, publish, promote, market, integrate, utilize, combine or otherwise use the content (including any translations thereof and the guest reviews) or our brand without our express written permission. To the extent that you would (wholly or partly) use or combine our (translated) content (including guest reviews) or would otherwise own any intellectual property rights in the website or any (translated) content or guest reviews, you hereby assign, transfer and set over all such intellectual property rights to HOTEL ALTERNATE.COM Any unlawful use or any of the aforementioned actions or behavior will constitute a material infringement of our intellectual property rights (including copyright and database right).
